These terms govern the Prairie Bones Partner Program — where an approved business (a "Partner") promotes and links to Prairie Bones products from its own website, and Prairie Bones LLC ("Prairie Bones," "we," "us") sells and fulfills those orders. By enrolling or placing our widget or links on your site, you agree to these terms.
Please read before relying on this: This is a plain‑language summary of how the program works. Final participation is subject to a signed Partner Agreement and is being reviewed by our attorney; nothing here is legal advice, and where a signed agreement differs, that agreement controls. We may update these terms (see Section 11).
1Independent contractor — not an employee or agent
You are an independent business. Nothing here creates an employment, agency, partnership, joint venture, or franchise relationship. You have no authority to bind Prairie Bones, to make promises on our behalf, or to represent yourself as us. You control your own website, marketing, schedule, and business expenses.
2How the program works
- We give you a unique Partner code and a widget/links for the specific products we approve for you. You may display and link to only those approved products.
- One website. Your Partner code is tied to the one website you register with us, and it works only there. Commission is earned only on purchases where the shopper starts on that website; links shared in email, social media or text messages, or your code placed on any other website, earn nothing. You may not share your code with anyone else. To change your registered website, contact us.
- What you can sell depends on your plan. Every Partner sells our treat line. Partners on the Plus plan may also display, link to, and sell The Prairie Bones Bag (our bag of beef chews) and earn commission on it. Partners on the Basic plan sell the treats only: they may not display, link to, sell, or earn commission on the bag, and shoppers who reach us through a Basic Partner's link see the treats, not the bag.
- When a shopper buys through your link, the order is placed, paid for, and completed on prairiebones.us — we are the seller of record.
- We handle payment processing, sales tax, fulfillment (through our maker, American Paws), shipping, customer service, and returns. You never handle money, card data, or customer personal information.
- We set all retail prices. You may not change prices, bundle, resell, or take payment for our products yourself.
3Commission
- On each qualifying order attributed to your code, you earn your plan's share of our retail price for each eligible item sold: 10% on the Basic plan (treats) or 22% on the Plus plan (treats and The Prairie Bones Bag; a 20% base commission plus a 2% bonus, both always paid). Calculated on the product price only, excluding sales tax and shipping. The bag is commissionable only on the Plus plan — see Section 2.
- Paws Points. Orders that come through your code or website do not earn Prairie Bones Paws Points (see our MyPack & Paws Points terms). Do not promise points to your customers.
- We cover card processing on these orders — it is not deducted from your commission.
- Partner subscription. Program access is an annual plan — Basic, $250 a year, or Plus, $500 a year — charged to the card you keep on file when you apply and renewed automatically each year unless you cancel. You can cancel any time from your partner plan page (prairiebones.us/prairie-bones-partner-manage.html); canceling stops renewal and removes your card from our payment processor. Your access continues through the end of the year you've paid for, then your code stops working. Subscription fees are non-refundable, including when you cancel partway through a year. If a renewal payment fails, your partner link is paused until it's paid.
- Commission is earned only when an order is actually paid. It is held until the end of the month, then netted against any refund or chargeback from that period before payout — so a reversed sale earns no commission and nothing is clawed back after the fact.
- We pay out monthly to the payment details you provide, with an itemized statement (your sales, your commission, and net). We may set a reasonable minimum payout and may hold funds where fraud or a dispute is suspected.
- Commission is your only compensation. We do not guarantee any sales, traffic, earnings, or product availability.
4Taxes & your W‑9
You are responsible for all taxes on your commission income. Before we can pay you, you must provide a completed IRS Form W‑9. If we pay you $600 or more in a calendar year, we will issue you a Form 1099‑NEC. Because you are a marketing referrer and we are the seller of record, you have no sales‑tax collection duty on these orders.
5How you may promote us
- Follow all applicable laws, including the FTC's advertising and endorsement rules — clearly disclose that you earn a commission when you promote our products.
- Make no false, misleading, or unauthorized claims. Do not make health, medical, curative, or dietary‑benefit claims about the treats beyond what appears on our own product pages.
- No spam, no unsolicited bulk email/text, no misleading ads, no bidding on our trademarks in paid search, and no incentivized or fake reviews.
- Keep your site's content lawful and brand‑appropriate. We may ask you to remove or correct anything about our products.
6Our brand & a limited license
We grant you a limited, non‑exclusive, revocable license to use the Prairie Bones name, logo, and product images solely to promote the approved products while you're an active partner. We own all of our intellectual property; you gain no ownership. This license ends the moment your participation ends.
7Customer data & privacy
Customers are Prairie Bones' customers. You will not receive their names, contact details, or payment information, and you must not attempt to collect, intercept, or store any customer personal or payment data through the program.
8No guarantees
The program and our products are provided "as is." We do not guarantee any level of sales or income, uninterrupted availability, or that the program will continue. Products are subject to availability, and we may add, change, pause, or discontinue products or the program at any time.
9Term, suspension & termination
Either of us may end your participation at any time, for any reason, with notice. We may suspend or terminate immediately for any violation of these terms, fraud, or conduct that harms our brand. On termination you must promptly remove our widget, links, name, logo, and images. We will still pay out commissions that were legitimately earned and unpaid before termination, except where fraud or chargebacks are involved.
10Liability & indemnification
To the fullest extent allowed by law, Prairie Bones is not liable for indirect, incidental, or consequential damages, and our total liability under the program will not exceed the commissions we paid you in the three (3) months before the claim. You agree to indemnify and hold us harmless from claims arising out of your website, your marketing, or your breach of these terms.
11Changes to these terms
We may update these terms. If a change is material, we will give reasonable notice (for example, by email). Continuing in the program after a change takes effect means you accept the updated terms.
12Governing law
These terms are governed by the laws of the State of Kansas, without regard to conflict‑of‑law rules. The exclusive venue for any dispute is the appropriate state or federal court located in Kansas.
